Peter Tomlinson qualified with the London School of Mediation, and is a member of the Civil Mediation Council. He has a background in the renewables and the utilities sector, and has a proven track record in mediating difficult disputes.

Peter is often able to weed out the root causes of conflicts and the real motivations behind deep-seated and entrenched positions. It’s from there that mutually agreed and long-lasting solutions can be found.

Peter has worked closely with the East Riding of Yorkshire Council’s Anti-Social Behaviour Team to resolve neighbour disputes. Results have been very successful and have helped to de-escalate anti-social behaviour, that could lead to further legal or criminal proceedings taking place.

Peter also has extensive experience of wayleave and easement issues surrounding utility maintenance and expansion projects, where a failure to successfully mediate a timely solution can severely delay a company’s targets.

Who is involved?  

One mediator, all parties involved in the dispute, plus legal representation if desired

The complainants, their legal representation, and ultimately a judge
What are the costs? All parties share the cost of the mediator. Costs are a fixed rate. And with outcomes normally reached in a day - the time scale and costs can be controlled!  

Often one party will be liable for all legal fees, which often run into Thousands of pounds, and with no fixed time scale or control over the outcome!

The Process

  1. Appoint a mediator and agree on venue, costs, date and time to meet
  2. Set out the ‘rules of engagement’
  3. Each party makes an opening statement
  4. The mediator facilitates an open, honest dialogue between the parties to reach an amicable resolution
  5. Parties are able to offer opinion and feedback privately with the mediator
  6. Prepare a settlement to be approved and signed by both parties.

The mediation process is focused on problem-solving techniques and not ‘winning versus losing’ which leads to better relationships and outcomes for everyone!
